Start with the reason and the shortest workable period
Ask why possession cannot transfer at closing and whether scheduling, moving, another closing, temporary lodging, storage, or a different closing date could solve the problem with less risk. A convenient request is not automatically a good fit for the buyer’s loan, insurance, moving plan, or intended occupancy. Write exact calendar dates and times instead of phrases such as a few days or until the next house closes. Consider weekends, holidays, moving-company availability, utility transitions, and realistic contingency time. Carrie can help map the logistics, but the parties should use appropriate legal documents and advice. The buyer should remain willing to decline an arrangement that conflicts with financing, safety, insurance, or the household’s needs.

Separate ownership, possession, and access
Closing may transfer title while the seller still occupies the property, so the agreement should address who may enter, for what reason, with what notice, and how emergencies are handled. Buyers should not assume ownership permits casual entry; sellers should not assume occupancy leaves every former owner right unchanged. Identify the key holder, lock and alarm status, contractors or movers who may enter, mail and package handling, pool or lawn service, and any prohibited changes. Privacy and Fair Housing obligations still apply. If the parties need legal interpretation or enforcement language, a Florida attorney should advise them. The practical goal is a written access protocol that avoids surprises while protecting people, property, and the final handoff.
Coordinate lender and insurance review before signing
A buyer’s lender may have occupancy requirements, and both parties need property-specific insurance guidance for the period after closing. Share the proposed dates, who will occupy, intended use, personal-property situation, and any special features such as a pool, dock, detached structure, or planned work. Ask licensed professionals what coverage, endorsements, evidence, or restrictions apply; do not assume the seller’s former policy continues or the buyer’s ordinary owner-occupied policy answers every situation. Neither Carrie nor the closing agent should guess. Keep written responses with the transaction file. If required coverage is unavailable or uncertain, solve that before treating a post-occupancy agreement as a harmless calendar accommodation.
Document condition at two different moments
Conduct the authorized pre-closing walkthrough under the purchase contract, then plan a separate condition and key handoff when occupancy ends. Use dated photographs and a checklist for rooms, appliances included in the sale, windows and doors, pool, yard, garage, dock or waterfront equipment, remotes, keys, trash, and agreed repairs. Distinguish ordinary use from specific obligations in the written agreement rather than improvising after an issue occurs. Never photograph private documents or occupants without permission. The parties should understand who reports damage, who may arrange urgent work, and how a disputed condition is handled. A security deposit or holdback does not prevent damage and should be structured only with qualified legal and closing guidance.
Assign utilities, maintenance, and casualty procedures
State who keeps electricity, water, internet, lawn, pool, pest, and other services active, who pays them, and when each transfers. Identify responsibility for routine care without authorizing unlicensed repair or creating vague promises. Add a safe process for leaks, power loss, storm preparation, fire, security concerns, or another event requiring immediate action. Official emergency directions always take priority over property convenience. No occupant should operate unfamiliar generators, shutters, lifts, pumps, or waterfront systems merely because closing has occurred. Written contacts, shutoff locations, insurer instructions, and service providers are more useful than a general promise to take care of the home.
Plan the exit and an alternative before closing
Set the final vacancy deadline, key and remote delivery, personal-property removal, cleaning expectation, walkthrough method, fund or document release process, and the professional to contact if possession is late. Moving plans should leave enough margin that one delayed truck does not automatically become a legal dispute. Buyers should protect their own lodging and moving schedule; sellers should confirm storage and backup accommodation. Contract rights, deposits, charges, eviction questions, and remedies require legal advice and written terms. Carrie can coordinate dates, access, checklists, and communication, but cannot guarantee vacancy or resolve a legal conflict. A sound plan is specific enough to follow and includes a lawful fallback nobody expects to need.

Frequently asked questions
Is seller post-occupancy the same as an ordinary rental?
Not necessarily. Its legal and insurance treatment is property- and agreement-specific; obtain qualified advice.
Can the buyer move belongings in before the seller leaves?
Only if the written agreement, lender, insurer, and parties authorize it; casual overlap creates risk.
Who keeps utilities on?
The written arrangement should assign each service, payment, transfer date, and emergency contact.
Should there be a second walkthrough?
A separate authorized condition and key handoff after vacancy is a practical safeguard.
